Terms of Service

1. Agreement to Terms

By accessing or using Focal's financial analytics platform ("Service"), provided by Anton Berndt ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms are governed by the laws of the Federal Republic of Germany.

2. Description of Service

Focal is a financial analytics platform designed to help D2C founders and businesses monitor financial KPIs, create forecasts, and analyze scenarios. The Service provides tools for manual data input and integration to visualize financial health.

3. User Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must notify us immediately of any unauthorized access to your account.
  • You must be at least 18 years old to use this Service.
  • One person or legal entity may not maintain more than one free account to abuse the service.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to any part of the Service or its related systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Reverse engineer, decompile, or attempt to extract source code of the software.

5. Financial Data and No Advice

Important: Focal is a tool for informational and analytical purposes only. We are not financial advisors, accountants, or legal counsels.

  • The Service does not constitute financial, investment, or tax advice.
  • You are solely responsible for the accuracy of the data you input.
  • Forecasts and projections are estimates based on your inputs and assumptions; actual results may vary.
  • You should consult qualified professionals before making significant financial decisions.

6. Intellectual Property

The Service, including its original content, design, features, and functionality, is and remains the exclusive property of Anton Berndt and his licensors. You retain ownership of the data you input into the Service; however, you grant us a worldwide, royalty-free license to use, reproduce, and process such data solely for the purpose of providing and improving the Service to you.

7. Subscription and Payment

Certain features of the Service may require a paid subscription. Prices are displayed in EUR. We reserve the right to modify pricing with 30 days' notice. Subscription fees are billed in advance on a monthly or annual basis. You may cancel your subscription at any time; access will continue until the end of the current billing period.

8. Right of Withdrawal (EU Consumers)

If you are a consumer in the EU, you have the right to withdraw from a paid subscription contract within 14 days without giving any reason. To exercise this right, contact us at hello@focal-forecast.com.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

For damages resulting from injury to life, body, or health, or from intentional or grossly negligent breach of duty, our liability is unlimited in accordance with statutory provisions. In the case of slight negligence, we are only liable for the breach of material contractual obligations (cardinal duties) limited to the typical, foreseeable damage.

10. Termination

We may terminate or suspend your account immediately for material breach of these Terms. Upon termination, your right to use the Service ceases immediately. We will retain your data in accordance with our Privacy Policy and legal obligations.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. The place of jurisdiction for all disputes arising from or in connection with these Terms is Berlin, Germany, provided you are a merchant, a legal entity under public law, or a special fund under public law.
